In a landmark decision aimed to address a century-old injustice, the Assam Legislative Assembly recently passed the Assam Fixation of Ceiling on Land Holdings (Amendment) Bill, 2025 opening the door for long-awaited land settlement for tea garden workers residing in labour lines across the State. The amendment, hailed as a transformative welfare measure, is set to benefit more than 3.33 lakh tea garden workers who have lived for generations on estate land without any formal ownership or legal title.
For decades, tea garden labour lines where workers and their families have traditionally lived have remained outside the ambit of statutory land rights.
Despite being the backbone of Assam’s globally recognised tea industry, workers continued to occupy these spaces without legal assurance of tenure, leaving them vulnerable to displacement and dependent entirely on the goodwill of estate authorities. The newly passed amendment seeks to correct this structural gap by making labour lines eligible for land settlement and enabling the Government to allot pattas to eligible worker families, ensuring housing security and legal protection for the first time.
This amendment excludes labour lines from the purposes ancillary to special cultivation. At present, tea garden workers residing in labour lines occupy land without clear legal title or statutory protection. The amendment, by excluding labour lines from ancillary purposes and providing for preferential settlement with tea garden workers, secures their land rights. This will ensure long-term housing security and reduce vulnerability to displacement.
The Bill authorises the Government to acquire lands under labour lines in such a manner as may be prescribed and provides that all rights, titles, interests and encumbrances of such acquired lands shall be vested in the Government.
Tea Tribes & Adivasi Welfare Minister Rupesh Gowala acknowledging the decision mentioned, “For the visionary Chief Minister Dr. Himanta Biswa Sarma nothing is impossible. Under his decisive leadership, our tea garden worker brothers and sisters have today received their long-awaited dignity and rightful land rights. The historic adoption of the “Assam Fixation of Ceiling on Land Holdings (Amendment) Bill, 2025” in the august Assembly marks a transformative moment for a community neglected for decades. Heartfelt gratitude to the Honourable Chief Minister for fulfilling his promise and securing a hopeful future for our tea worker community.”
He added the bill will pave the way for 3.33 lakh families across 825 tea gardens to finally receive land rights after more than 200 years.
“Through this landmark legislation, approximately 2 lakh bighas of land will be allotted as pattas to tea worker families. A transformative step towards their socio-economic empowerment,” the Minister informed.
As a representative of the State Government, Gowala also met & interacted with the leaders of the Tea-Tribe Adivasi Yuva Samaj.
The Chief Minister speaking about the development said, “From generations of uncertainty to a future of ownership. The Land Ceiling Amendment Bill 2025 will give over 3.30 lakh families of Assam’s tea community legal rights to their land. A giant leap for justice and a historic moment for Assam.”
Meanwhile, in tea estates across Assam, the response among workers was emotional and overwhelmingly hopeful.
Rina Tanti, a third-generation worker from Laboc Tea Estate of Cachar said the decision feels like a historic relief, “For years, we lived with the fear that one eviction notice could change everything. Today, it feels like we finally have a place we can call our own—not just for us, but for our children.”
At a labour line in Oating Tea Estate of Golaghat, 58-year-old worker Bikas Oraon echoed similar sentiments, “My grandparents and parents were born here, worked here, died here without owning a single inch of the land they lived on. If the Government gives us patta, it will be the first real security our family has had in generations.”
The passage of the Bill represents a moment of long-awaited recognition that promises not only legal ownership but also dignity, stability and the possibility of a more secure future for generations to come.
